Preamble

WE, the members of the First City Council of Polinét,

ACKNOWLEDGING the need to regulate traffic to prevent accidents, promote the smooth flow of traffic, and reduce traffic congestion;

REALIZING that it is the responsibility of the local government to enact laws that promote public safety and welfare;

UPON THE APPROVAL OF PRIME MINISTER AND MAYOR OF POLINÉT ITZCOUNTRYBALLS, HEREBY DECLARES ORDINANCE NO. 0003, S. 2023 TO BE VALID.

Chapter 1: General Provisions

Article 1: Title

  1. This ordinance shall be known as the "Second Polinét Traffic Regulations Ordinance of 2023."

Article 2: Terminology

  1. For the purposes of this ordinance, the following terms shall be defined as follows:
    1. "traffic" refers to the movement of vehicles, pedestrians, or other conveyances on a street, road, or highway;
    2. "driver" refers to any person who operates a vehicle on a street, road, or highway;
    3. "vehicle" refers to any conveyance that is designed to be propelled by an engine or motor, including but not limited to cars, motorcycles, bicycles, and trucks;
    4. "street" refers to any public thoroughfare that is open to traffic, including but not limited to roads, highways, alleys, and sidewalks;
    5. "traffic congestion" refers to the condition where the volume of traffic exceeds the capacity of the street or highway, resulting in slower speeds, longer travel times, and increased risks of accidents and delays.

Chapter 2: General Provisions

Article 3: No Overtaking in Traffic

  1. No driver shall overtake another vehicle while in traffic.
  2. For the purposes of this article, "in traffic" means any time the vehicle is traveling at a speed less than 25 kilometers per hour and is part of a line of vehicles moving in the same direction.
  3. Any driver who violates this provision shall be subject to a fine of not less than 500 Soles and not more than 1,000 Soles.

Article 4: No U-Turns

  1. No driver shall make a U-turn on any street or highway where such a turn is prohibited by a sign or a road marking.
  2. Any driver who violates this provision shall be subject to a fine of not less than 500 Soles and not more than 1,000 Soles.

Article 5: Duty to Obey Traffic Signs and Signals

  1. Drivers must obey all traffic signs and signals, including but not limited to stop signs, yield signs, and traffic lights.
  2. Any driver who violates this provision shall be subject to a fine of not less than 500 Soles and not more than 1,000 Soles.

Article 6: Prohibition of Reckless Driving

  1. No driver shall engage in reckless driving, which is defined as driving a vehicle in a manner that endangers the safety of persons or property.
  2. Examples of reckless driving include, but are not limited to, speeding, weaving in and out of traffic, and failing to yield the right of way to other vehicles or pedestrians.
  3. Any driver who violates this provision shall be subject to a fine of not less than 1,000 Soles and not more than 5,000 Soles, and may have their driver's license suspended or revoked.

Article 7: Enforcement and Penalties

  1. The Polinét Traffic Enforcement Unit shall be responsible for enforcing the provisions of this ordinance.
  2. Any driver who violates any provision of this ordinance shall be subject to the penalties specified in the respective articles.
  3. Any fine imposed under this ordinance may be appealed to the Polinét Traffic Appeals Board, whose decision shall be final and unappealable.

Chapter 3: Final Provisions

Article 9: Repealing Clause

  1. All ordinances, rules, regulations, or parts thereof that are inconsistent with this ordinance are hereby repealed or modified accordingly.

Article 10: Effectivity

  1. This ordinance shall take effect fifteen (15) days after its publication in a newspaper of general circulation in Polinét.
